1. Agreement to Terms

By accessing or using Rachel AI ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Rachel AI provides AI-powered phone answering, lead qualification, appointment scheduling, and communication automation services for businesses. The Service includes a web-based dashboard, phone system integration, SMS messaging, and related tools.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, including TCPA regulations
  • Send unsolicited commercial communications (spam)
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any systems

5. TCPA Compliance

You are responsible for complying with the Telephone Consumer Protection Act (TCPA) and all applicable telemarketing regulations. The Service provides consent tracking and opt-out management tools, but ultimate compliance responsibility rests with you.

6. Payment Terms

Paid plans are billed monthly in advance. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

7. Call Recordings

The Service may record phone calls for quality assurance and AI training purposes. You are responsible for complying with all applicable call recording laws in your jurisdiction, including obtaining any required consent from callers.

8. Data Ownership

You retain ownership of all data you input into the Service, including contact information, call recordings, and business data. We do not sell your data to third parties.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any losses resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Rachel AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and your data will be retained for 30 days before deletion.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
